網(wǎng)絡(luò)安全與數(shù)據(jù)治理

摘要： 隨著數(shù)字化手段對(duì)科技的革命與產(chǎn)業(yè)的升級(jí)，社會(huì)中也滋生了各種互聯(lián)網(wǎng)平臺(tái)亂象與違法犯罪行為。網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)作為我國(guó)可信網(wǎng)絡(luò)身份戰(zhàn)略的重要推進(jìn)，如何對(duì)網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)進(jìn)行全面優(yōu)化是當(dāng)前亟待解決的問題。通過梳理我國(guó)網(wǎng)絡(luò)身份認(rèn)證的提出與發(fā)展進(jìn)程，圍繞公民網(wǎng)絡(luò)身份數(shù)據(jù)權(quán)利視閾、價(jià)值風(fēng)險(xiǎn)視閾、制度建設(shè)視閾三個(gè)維度，分析網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)所形成公共數(shù)據(jù)的權(quán)利應(yīng)然，聚焦公共數(shù)據(jù)的價(jià)值實(shí)然與網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)的風(fēng)險(xiǎn)似然，探索網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)在制度建設(shè)過程中的優(yōu)化策略。

Exploring the development path of network identity authentication public service under three-dimensional perspective

Abstract： Accompanied by the digital means of the revolution in science and technology and industrial upgrading, society has also bred a variety of Internet platform chaos and illegal and criminal behavior. Network identity authentication public service is an important promotion of China′s credible network identity strategy, but how to optimize the public service is an urgent problem to be solved. Through sorting out the proposal and development process of network identity authentication in China, we analyze the right contingency of public data formed by public services, focus on the value reality of public data and the risk likelihood of public services, and explore the optimization strategy of public services in the process of system construction by focusing on three dimensions,which are the right threshold of citizens′ network identity data, the value risk threshold, and the system construction threshold.

引言

隨著科技革命與產(chǎn)業(yè)升級(jí)的深入推進(jìn)，近年來，人類社會(huì)的生活方式、生產(chǎn)方式和治理方式都依托于數(shù)字化網(wǎng)絡(luò)手段進(jìn)行了轉(zhuǎn)型升級(jí)。在媒體推廣和商業(yè)利益的推動(dòng)下，信息網(wǎng)絡(luò)技術(shù)迅速成為社會(huì)熱點(diǎn)，受到社會(huì)各界的廣泛關(guān)注。這也引發(fā)了犯罪人依靠其進(jìn)行犯罪手段升級(jí)，包括但不限于“詐騙案中的假臉假聲技術(shù)”“侵犯公民個(gè)人信息案中的數(shù)據(jù)濫用技術(shù)”“破壞網(wǎng)絡(luò)信息安全案中的自動(dòng)攻擊技術(shù)”等［1］。在網(wǎng)絡(luò)發(fā)展的過程中也出現(xiàn)部分自媒體賬戶在網(wǎng)絡(luò)社交平臺(tái)通過傳播不實(shí)消息、炒作熱點(diǎn)事件、制造群體對(duì)立、消費(fèi)社會(huì)愛心等行為實(shí)現(xiàn)惡意流量變現(xiàn)。除此之外，網(wǎng)絡(luò)上還存在“編造虛假人設(shè)引流”“利用偽科普傳播不良消息”“軟色情違規(guī)引流”“夸大商品功效欺騙消費(fèi)者”等營(yíng)商網(wǎng)絡(luò)亂象。這些現(xiàn)狀引發(fā)了網(wǎng)絡(luò)可信身份戰(zhàn)略的確立及推進(jìn)國(guó)家網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)建設(shè)的公眾需求。

自2002年以來，李希光教授率先提出“應(yīng)禁止任何人網(wǎng)上匿名”，自此網(wǎng)絡(luò)實(shí)名制開始在學(xué)界展開探討。2012 年，全國(guó)人大常委會(huì)通過《關(guān)于加強(qiáng)網(wǎng)絡(luò)信息保護(hù)的決定》，明確了國(guó)內(nèi)網(wǎng)絡(luò)實(shí)名制治理的要求［2］。2015年，國(guó)家網(wǎng)信辦出于整頓互聯(lián)網(wǎng)亂象的目的，發(fā)布的《互聯(lián)網(wǎng)用戶賬號(hào)名稱管理規(guī)定》中提出按照“后臺(tái)實(shí)名、前臺(tái)自愿”的原則認(rèn)證使用者真實(shí)身份信息［3］。2024年，公安部發(fā)布《國(guó)家網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)管理辦法（征求意見稿）》（以下簡(jiǎn)稱《管理辦法》），提出按照自愿原則推廣互聯(lián)網(wǎng)登記服務(wù)中應(yīng)用網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)管理。這使得網(wǎng)絡(luò)可信身份戰(zhàn)略以網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)的形式進(jìn)入應(yīng)用階段。

網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)是指國(guó)家根據(jù)法定身份證件信息，依托國(guó)家統(tǒng)一建設(shè)的網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)平臺(tái)，為自然人提供申領(lǐng)網(wǎng)號(hào)、網(wǎng)證以及進(jìn)行身份核驗(yàn)等服務(wù)［4］。網(wǎng)絡(luò)身份認(rèn)證公共服務(wù)的目的旨在保護(hù)公民的身份信息安全與促進(jìn)國(guó)家數(shù)字經(jīng)濟(jì)發(fā)展。網(wǎng)號(hào)是指與公民自然人身份所對(duì)應(yīng)的由字母與數(shù)字組成，不含個(gè)人身份信息的網(wǎng)絡(luò)虛擬身份符號(hào)；網(wǎng)證是指承載網(wǎng)號(hào)及自然人非明文身份信息的網(wǎng)絡(luò)身份認(rèn)證憑證。依托于網(wǎng)號(hào)與網(wǎng)證，在互聯(lián)網(wǎng)服務(wù)及相關(guān)行業(yè)管理中以非明文登記的方式核驗(yàn)自然人身份信息。
